Customers’ Terms of Use

  1. Introduction

These Terms of Use apply to the website at www.dotiv.life  (the “Site”). You can print off these terms, or store them in your computer or other device, for future reference.

By accessing and/or using the Site, including any services available through the Site (the “Services”), you agree to be legally bound by these Terms of Use, as amended from time to time.

You must be at least 18 years of age to use the Site.  By using the Site and agreeing to these Terms of Use, you represent and warrant that you are at least 18 years of age.

If you do not accept any of these Terms of Use, then please do not use the Site.

  1. The Site

The Site is provided by Preventive Care Limited, registered in England and Wales, registration no. 12969092 (“we”, “us” or “our”). Our registered address is at 31 Kentish Town Road, London, England NW1 8NL, England.

Any reference in these Terms of Use to “you” or “your” means you as a visitor to or user of the Site. Where you are acting on behalf of a corporate or other entity, this includes a reference to that entity.

We reserve the right to change the way the Site works, to withdraw any features of the Site or its contents, and to add to, withdraw, or otherwise modify the Services from time to time without giving any prior or other notice to you.

  1. Use of the Site

The Site provides general information about us and the Services. If you wish to subscribe to or  purchase any of the Services, additional terms and conditions will apply.

Nothing in the Site constitutes medical advice, or an offer of any services.

Customers can cancel a booking 24 hours before booking commencement and the original payment excluding platform administrative fees will be refunded to the customer. Any bookings cancelled by customers within 24 hours before booking commencement will not be refunded. 

Users should seek to mutually resolve any disputes regarding services provided on the site. Should any dispute still remain, you should contact the Customer Support team via the Contact Us page on the site. We reserve the right to cancel or refund any bookings made on the site depending on our assessment. 

If you choose to access the Site from outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

The Site may be required to collect taxes (VAT, GST or other such taxes) and taxes will be included to any prices seen displayed on the site.

You are not permitted when using the site to:

  • Use any offensive or harmful language: we do not accept any bullying, harassment or discriminatory behavior on the site, and any such behavior as deemed by us to be offensive or harmful will be a breach of these Terms of Use.
  • Share information of any other users: user’s information is confidential and is not permitted to be shared on or outside the site. Any inappropriate use of any data from the site as deemed by us will be a breach of these Terms of Use.
  • Give fake or fictitious information to the site or any users on the site: any actions deemed as misleading others on the site as deemed by us will be a breach of these Terms of Use. 

If you breach any of the provisions of these Terms of Use, we may immediately terminate your use of the Site and you will be solely responsible for any losses and costs resulting from your breach. We reserve the right to exercise discretion in resolving any disputes and make a final decision on such matters, and the affected party should seek independent legal advice should they so wish.

  1. Intellectual Property Rights

The rights in and to the www.dotiv.life domain name, all copyright, database right, trade mark (including trade mark no. UK00003565770) or other intellectual property rights (“IPRs”) in any part of the Site or its content (including text, data, graphics and any other material) are owned by or licensed to us. All rights not expressly granted are reserved to us.

No IPRs contained or used in the Site (or any part of it) are intended to, and they shall not be deemed to, be transferred to any person who accesses and/or uses the Site or the Services.

Except as expressly permitted by these Terms of Use or as otherwise agreed in writing with us, you may not copy, disseminate, or download any content of the Site.

  1. Availability of the Site

We reserve the right to suspend the Site at any time for operational, regulatory, legal or other reasons.

We cannot guarantee that the Site will be available at all times without interruption.

Although we make reasonable attempts to ensure that the server that makes the Site available is bug and virus free, we cannot provide any guarantee in this respect.

  1. Links to other sites

The Site may provide links to other websites. Selecting any of these links will direct you to a website that is not related in any way to us. These third party websites and resources may have their own terms of use and privacy policies and you should review them. We take no responsibility for the content contained on any such website, and your access and use of such services and content is at your own risk. Any link we may provide to these other websites does not imply an endorsement or recommendation of the website, its products or services.

Before supplying any personal information to any other website, we recommend that you check that website’s privacy policy. We do not accept responsibility for the protection of any data supplied to other websites.

  1. Practitioner Disclaimer

Our digital healthcare services are for information relating to your health and to let you know about general causes, risks and possible next steps. They are not designed to diagnose you and should never be used as a replacement for a qualified medical or therapeutic professional advice or treatment.

We, our affiliates and businesses and its practitioners (“dotiv Practitioners”) neither endorse nor are responsible for the accuracy and reliability of any products, services, events, opinions, advice, or statements made on the Site by anyone other than an authorized representative of us while acting in their authorised official capacity.

Complementary and alternative healthcare practices, such as Ayurveda, Traditional Chinese Medicine, Homeopathy, Naturopathy, Osteopathy and Chiropractic, are      recognised as being a method of health care system for many medical conditions. However, you must recognise that there are limitations and risks associated with all health care products and procedures which you should be informed about.

Complementary and alternative healthcare is based on the idea that each person’s path toward optimal health is unique. Any advice given to you by a dotiv Practitioner is based on understanding of your unique conditions and imbalances. They may include lifestyle adjustments, dietary changes, herbs and other such treatments,  which will be suggested by dotiv Practitioners at the time of your initial consultation.

When you avail any service such as, but not limited to, diet consultation, therapeutic massage and herbal remedies provided by us, you acknowledge and agree that, not all of the benefits provided such complementary and alternative healthcare procedures and treatments are clinically proven. 

We do not advise you to use any of these digital healthcare services for emergency. Instead, call 999 or the emergency services immediately. You should always talk to a qualified healthcare professional if you have questions about your health or a medical condition. And before you make any decisions about your health.

  1. Testimonials Disclaimer

The Site may contain testimonials by users of our products and/or services. These testimonials reflect the real-life experiences and opinions of such users. However, the experiences are personal to those particular users, and may not necessarily be representative of all users of our products and/or services. We do not claim, and you should not assume, that all users will have the same experiences. Your individual results may vary. 

The views and opinions contained in the testimonials belong solely to the individual user and do not reflect our views and opinions. We are not affiliated with users who provide testimonials, and users are not paid or otherwise compensated for their testimonials.

In no event will we or dotiv Practitioners be liable with respect to any subject matter under these Terms of Use or our service under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of any data; or (iv) for any amounts that exceed the fees paid by you to us under these Terms of Use or our service during the twelve (12) month period prior to the cause of action. We shall have no liability for any failure or delay due to matters beyond our reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

11. General Representation and Warranty

You represent and warrant that (i) your use of the Site will be in strict accordance with the our Privacy Policy, with these Terms of Use and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside) and (ii) your use of the Site will not infringe or misappropriate the intellectual property rights of any third party.

If you breach these Terms of Use and we choose to ignore this, we will still be entitled to rely on our rights and remedies at a later date or in any other situation where you breach these Terms of Use.

If any provision or part-provision of these Terms of Use is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph shall not affect the validity and enforceability of the rest of these Terms of Use.

All notices from us to you will be displayed on the Site from time to time or emailed to the email address you have provided.

17. Termination

We may terminate your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate our service or your dotiv.life account (if you have one), you may simply discontinue using the Site. Notwithstanding the foregoing, if you have a paid services account, such account can only be terminated by us if you materially breach these Terms of Use and fail to cure such breach within seven (7) days from our notice to you thereof; provided that, we can terminate the use of this Site immediately as part of a general shut down of our service. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, intellectual property rights provisions, warranty disclaimers, indemnity and limitations of liability.

18. Governing Law and Jurisdiction

These Terms of Use are governed by English law, and you and we agree to submit to the jurisdiction of the English courts, which will have exclusive jurisdiction over any dispute or claim (including any non-contractual claim).

19. Changes to these Terms of Use

We may change or add additional terms to any element of these Terms of Use from time to time if:

  • we alter the Services we provide; or
  • we add new services to the Site; and/or
  • we need to do so for security, regulatory or legal reasons.
